These General Terms and Conditions govern access to and use of the HICARI platform, owned by HICARI BRAND S.L. with CIF B22789945 and registered address at Calle Marcenado, 46, Madrid, 28002, available at https://hicari.io/.
The purpose of HICARI is to connect companies and Brands (hereinafter, “Brands”) with content creators (hereinafter, “CREATORS”) in order to facilitate the creation of original advertising or promotional content for use on social networks and other organic and promotional media for the BRANDS.
Registration and use of the platform imply full acceptance of these terms and conditions, which may be updated.
1. Purpose
The purpose of the HICARI platform is to connect companies (“BRANDS”) with the social media user community (“CREATORS”) and to facilitate social media marketing, the creation of user-generated content, and other tasks. To this end, CREATORS may create films, videos, animations, audiovisual works, or other media (“Content”) and sell the rights to such Content to the Brands.
The CREATOR grants the BRAND the usage rights to the audiovisual content generated in response to the accepted brief through HICARI, in accordance with the specific terms and conditions thereof.
1.1 The HICARI Creator Rewards terms and conditions set out the specific characteristics of this HICARI service. To view the general terms and conditions of HICARI, go to: terms and conditions.
2. Terms of Service on HICARI
2.1 This Agreement sets forth the complete understanding between the parties regarding its subject matter, replaces all prior versions of the Agreement, except for any separate written agreements existing between the parties regarding such subject matter, and may be modified at any time without prior notice. Notwithstanding the foregoing, the latest version of the Agreement governs all Content, including Content created previously. Any modification to this Agreement will be published on this page and will indicate the latest review. Any modification to the Agreement will come into effect immediately after its publication on this page. Continuing to browse the HICARI websites or using the HICARI services will constitute your acceptance of any modification made to the Agreement. Notwithstanding the foregoing, in the event of a conflict between the terms of this Agreement and any other terms and conditions, end-user license agreements, or privacy policies, the terms of this Agreement shall prevail.
2.2 HICARI reserves the right to modify the Platform or the Creator Rewards program as it deems appropriate. This applies to both functionalities, prices, and terms and conditions. Any modification will be made without prior notice and the information found in the service terms and/or landing page at the time you use it will be considered current.
3. Terms Applicable to CREATORS
3.1 The CREATOR must be over 18 years of age. The CREATOR will confirm their age when registering on the HICARI platform, indicating their actual age and being responsible for the information provided.
3.2 Provide accurate and up-to-date personal, contact, and social media information. This includes information about the social media account and the publication, in order to verify the authenticity of the content and avoid bad practices.
3.3 HICARI reserves the right to reject the video of the CREATORS until the requirements provided meet the committed and desired standards and/or not to accept the creator into the program if it observes or detects indications of bad practices.
3.4 If the CREATOR does not meet the minimum standard committed, they may not be able to participate in the program and may be removed from the platform.
3.5 The CREATOR is the owner of the Intellectual Property Rights of the Content. The published content is authentic and original, in accordance with, and is not previously published on any other of their own channels or those of third parties.
3.6 The Content does not violate the privacy rights, contractual rights, or other rights (including Intellectual Property Rights) of any person, corporation, or entity.
3.7 The CREATOR agrees that they will be compensated by HICARI. Such compensation will be made via platform balance. The creator must reach the platform’s minimum amount in order to withdraw the balance.
3.8 The CREATOR declares their legal and tax responsibility for receiving payments according to their applicable tax regime. HICARI will declare the payments made, so it will be necessary for the CREATOR to be able to issue an invoice in order to receive payment. HICARI is not responsible for the tax regime or legal situation of each CREATOR registered on the platform.
4. Creator Terms
4.1 The CREATOR must have an account with a minimum of 100 followers
4.2 The creator’s account must be at least +90 days old.
4.3 The account profile must be public. Videos are not accepted on private accounts.
4.4 The CREATOR must have a minimum posting history of more than 6 videos or pieces of content on their profile.
5. Payments to the creator
5.1 The video creation is carried out in exchange for the agreed and accepted payment. €15 as the base payment plus a bonus depending on the views reached for that video. The CREATOR declares their legal and tax responsibility for receiving payments according to their applicable tax regime. HICARI will declare the payments made, so it will be necessary for the CREATOR to be able to issue an invoice in order to receive payment. HICARI is not responsible for the tax regime or legal situation of each CREATOR registered on the platform.

The maximum amount payable per video: €205 (€15 + €190). This is the only payment and is valid only for the first video delivered to HICARI.
5.3 The approved video receives a base payment of €15. Bonuses for views are calculated by tiers. Views are counted during the 30 days following publication.
5.4 HICARI reserves the right to conduct manual review in the event of suspicious activity. Bots, buying views, payment for advertising, or artificial engagement are not allowed. Videos must be 100% organic. Failure to comply with the rules voids the payment and may result in HICARI removing the creator forever.
6. Content usage rights and ownership
The CREATOR does not transfer or assign to HICARI the rights, titles, and interests of the Content.
6.1 The CREATOR grants HICARI the right to republish and use on its channels for promotional purposes the creator video, and may request the content for download and organic use. Without Paid.
7. Use of content by the CREATOR
7.1 The CREATOR is the owner of all Intellectual Property Rights in the Content or, failing that, guarantees that the use of the music in the content is free of rights.
7.2 The CREATOR ensures that any video clip, image, or element used in the recording or editing and uploaded as HICARI is the owner or has the rights to use it commercially in order to include it within the final published content.
8. Modification of the content
8.1 HICARI may not edit and format the Content in the formats or versions that HICARI requires for its use in the media it requires. However, HICARI and the CREATOR may agree on modifying it.
8.2 HICARI may not use the content for AI training purposes.
9. Duration
9.1 The CREATOR undertakes to keep the publication visible on their profile for a minimum period of 12 months from the publication date, unless HICARI requests in writing its removal before that period.
10. Territorial scope
10.1. The assignment is valid for use worldwide, without geographical restriction.
11. Warranties
11.1 The CREATOR undertakes that the creator content is not illegal or contrary to the laws, the applicable industrial code, the requirements, or the instructions of the relevant regulators. Whether it is copied or adapted, in whole or in substantial part, from any other work or material. Whether it is indecent, obscene, threatening, discriminatory, harassing, that violates trust, defamatory, offensive, or objectionable, or that contains, represents, alludes to, or promotes aggressive, undisciplined, antisocial, lascivious, or illegal behavior, or sexually suggestive images;
11.2 To parody, belittle, or make fun of HICARI, its products or services, or of HICARI in general, in any way.
11.3 By this means, HICARI authorizes the creator to use its corporate name and to display its registered BRAND, logo, or other corporate insignia of the Platform for the creation of the video.
11.4 The CREATOR guarantees that: they are the original author of the content provided or have all the necessary rights to assign it.
12. Breach by the CREATOR
12.1 If the content provided does not meet the minimum requirements specified and, after a first opportunity to correct it, HICARI may consider the video as not suitable.
13. Promotional use by HICARI
13.1 HICARI may use, free of royalties, in perpetuity, worldwide, irrevocably, non-exclusively, and transferable, fragments or full videos of the content generated through its platform, social networks, or other HICARI channels, as part of its corporate portfolio, to show examples of real cases and campaigns carried out.
